Bull hockey. If the crossing meets Federal Railroad Administration guidelines and the train was operating within FRA rules, then no lawsuit should be allowed. I hate to say it, but there’s a point when you have to back off from saving the vehicle or people on the tracks. If I were the railroad, I’d countersue for not having a safe vehicle on the road while crossing railroad property.
