So lets talk about this for a minute. Yes, Juarez was convicted of commiting sexual assault, but not rape, and then is charged with kidnapping as well, again it was because he was said to not have allowed the victim to leave. Court transcripts read that two witnessess, which Smith did not allow, seen the two together previously making out in a vehicle. What Juarez did afterwards was not right, and he would be doing 6yrs for this crime which one could say was fair. Now I don’t know the guys past, but it would stand to reason if he was this type of threat, then tell us why the guy never served any time in prison? If we use a law that politicians put in place to put level 3 offenders in prison to protect the public, which Juarez is not, then why impose a life sentence? Tell us all why is he being put in prison for life why other sex offenders especially child molesters in this county are again back on the streets, because they served their time? I have to agree with his attorney, this should be over-turned when it reaches the upper courts. We have had several predatory child molsters in recent years who served time in prison, violated their terms, according to records, and were sent back for a number of months, yet never faced life for violating conditions of release. One sex offender only just a few months ago molested 3 kids, and maybe more kids at a daycare center, So he gets 58 months? This guy probably had a better high paying attorney with more resources from the looks of it. I don’t care for sexual offenders, but never in all my law enforcement experience, have I seen this display of over berring justice. Something is not right here, and its up to Juarez’s attorney to make a case for over turning this sentence. Several murders in this county didn’t get life especially one who in cold blood stabbed another man to death. Then we have another guy who murdered his wife in a fit of rage, put her behind the wheel of a vehicle, and attempted to coverup the crime by staging an accident, yet he got 12yrs? Something appears wrong with the system.

Jimmy I believe this man has a pretty long list or prior offenses. I believe it was in a story prior that talked about previous violent attacks that he committted. Wondering if perhaps those also factor into this decision.

Good points Mike and Bella, but what is certainly troubling is why this man never served time in prison? You have to ask yourself did this county fall asleep and are now trying to make it right in the wrong fashion? I believe prison time is just no one is arguing that, but life sentence bugs me because he was not a level 3, or was he ever sentenced to prison for what he was arrested and convicted for in the past, now why is that? There is always 2 sides to every story and if these two had prior contact it only serves to why they both ended up in an area were the assault took place. Now maybe the women got cold feet, or just walked to that area for a smoke break to get away from Juarez, and in his drunk state thought he could continue his brief relationship of the victim. Now Juarez did not just pick her at random, oviously something prior took place. After rejection Juarez tried to force himself on the women which is why he is going to prison. I argue the life sentence and if the county messed up in the past you can’t use the past or the future to put a person away for life who did not commit murder or great bodily harm.

You may just have a point, Jimmy – looks like Judge Kathryn Smith handled the first Crim sex in 1997 that was pled down to 3rd dg…with probation expiring in 2007. She may have some knowledge from then that influenced her decision now. Looks like Jose has never hit that magic “3rd conviction within 10 years” for any particular offense (that would give him stiffer penalties), and he pays his fines quickly and completes probation early… so, on the back end of the convictions, he’s a model citizen – it’s that front end, when he gets involved with alcohol or other substances, that his judgement seems to lapse.
The problem is – Jose doesn’t seem to be slowing down in terms of his criminal activity – things seem to be escalating for him the past several years. While I agree that the penalty imposed may be, in fact, a bit harsh when comparing other recent convictions and sentences… I do think Jose needs to spend some serious time behind bars. I think it’s time an impression is made upon him, as it certainly hasn’t been previously.
That – and I’ve actually met this guy, a few times over the years. There aren’t a lot of people who get the hair on the back of my neck to stand up… but Jose, he did. And I don’t react to people like that often – not even those prison hard-arses I’ve worked with. Just something about him – can’t even put my finger on it, really – but there’s something that made the warning bells in my head go off.
