Fargo women’s clinic abortion doctor won’t be charged
November 16, 2010 at 6:00 pm in INFORUM
The Cass County state’s attorney has declined to bring criminal charges against a doctor at the Red River Women’s Clinic who performed abortions with a temporarily expired state medical license. Continue Reading

It’s good to hear she was treated just like any other Dr. who let their medical license expire. Everyone should be treated the same.
I’m going to make a wild prediction (I can’t help myself :p) that this thread is going to turn into a Bible verse shootout not pertaining to the topic at hand whatsoever.

I woul certainly hope that MY medical doctor was treated according to the law and would be required to keep their license current. They do have people hired to keep their licenses current and other clerical duties. It’s not like they have to do everything themselves like alot of us.

And what if it was his clerk’s responsibility to make sure his licenses are kept up to date and paid.. Its my office managers responsibility to do that for mine.

When was the law passed? Where can people find it? Please let us know where this information is. I for one would like to see it for myself, so I can know if this is a real law or not.

Becky, you are absolutely correct. my late wife used to say that what a woman did with her body was her business, and she would go on to say “if you don’t want an abortion, don’t have one!” we will surely get a short course on bible interpretations today!

Section Section 14-02.1-07 of the Century Code states that “the state department of health shall report to the attorney general any apparent violation of this chapter (the Abortion Control Act.)”

I wonder if I forget to renew my drivers license or license plates and get picked up if I can get a fine or be prosecuted or if I can just use the administrative oversight excuse???

That depends… If you are performing abortions in the back of a van you may be able to pull it off. Just as long as you are not on your cell phone.

Well it’s good to see Bishop Aquila speaking out for (his version of) morality. No doubt we can expect to see him quoted for advocating for the arrest of the pope for his cover up of years of systematic child abuse.

The decision not to prosecute was the right one. Whether or not you approve of abortion, the lapse in license was just an oversight. To prosecute would obviously be showing bias.

Why have a licensing requirement for anything (doctors, drivers, contractors, etc.) if they can be aquired after the fact?
Hot debate. What do you think?

There’s a BIG difference between never having had a license and having the license momentarily lapse. The physician’s medical requirements were all up to date.

No fine? whaaaat? come on, I let my motorcycle permit lapse three days, showed up in court with a current license and no love for me. The court gave me fine and 4point off my driver’s license.
The states attorney considers driving a motorcycle with an expired permit more dangerous to the public than performing a medical procedure on the human body without the appropriate license. Hmm!
When will the law apply fairly to everyone?

The law does apply fairly to everyone. All physicians with lapsed licenses (assuming their medical cred’s are up to date) are allowed to renew with a small fine for the late renewal.

But there is a separate section of the law that applies to abortions. Like it or not, this is not just about physician licensing.

If someone isn’t an “abortion supporter” does that mean they want abortion to be a criminal act for both performer and receiver? What punishments would be levied against these folks?
I’m not arguing for or against either side, I’m just posing the question.

This story is really a non-issue. For the authoritarians on here, anything that would allow them to charge the doctor with a crime is A-OK in their book, but that’s not a good use of taxpayer dollars. I wonder how they feel about people who forget to renew their tags, or their driver’s license. Should those people be locked up? Should we make sure they lose their jobs? Their homes? What, pray tell, is an appropriate punishment for someone who forgets to renew their license?
It’s not as if this person lost all their accumulated knowledge of the subject the day the license was to be renewed. At most–the very most–this is a clerical error that deserves a small fine. Sometimes you have to accept some things you don’t approve of are frustrating, but not jail-worthy crimes.
The people on here shouting about how abortions are terrible and freaking out, frankly, are people who have some very scary ideas of what “freedom” in this country means. Locking someone up at the slightest provocation is not the sign of an open society.

Most are not saying that she should go to jail. The circumstance may warrant a small fine. What is troubling is that Burdick chose to disregard the law entirely.

That sounds like the “slightest provocation” I was speaking of. Seriously. Why do conservatives always want a state or federal solution to everything? Talk about your ‘Nanny State’…

I’ll try that if I get caught for driving without a license – “I had a license. It’s not like I forgot how to drive. Lighten up officer. Quit wasting taxpayer money on stopping me.”

I agree lets not waste tax payer’s dollars. Fine the Doc and move on, but not a small fine as you suggest. These doctors make enough to pay a $500-1000 fine. This fine would help pay for the oversight and the states attorney time.

Interesting how, when there is no other argument to be made, it immediately becomes a liberal v. conservative issue, even though it has nothing to do with political parties. Very interesting.

Lol they had no choice but to go that route because I started the thread off saying this will turn into a Bible verse shootout. The last article they ran on this story was verse after verse of both sides quoting against each other. Gosh that’s annoying I’d rather force them into conservative v liberal if they insist on not discussing the actual topic.

I appreciate intellectual discussion about deeper issues. A Bible verse shootout with each side quoting random verses is not an intellectual discussion. Neither is a general rant against conservatives or liberals.

You have never made a post deeper than a dimple, yet you spout off about how annoying the discussions are between other people; as though what you have to say is worth more than dust on the bottom of a shoe. Your arrogance is undeserved. Thank you for your oh so enlightened view about what other people should be talking about. Like you said though, this thread had no choice but to go that route because you started the thread by saying it would. Good call. You were soooo right. Pat on the back for you. Gold star for the day.

Those praising Burdick’s decision should read his memo. What it amounts to is: “I agree with the law, so I won’t enforce it.” Would you think that was okay if he had said that about date rape?
