North Dakota will spend at the MINIMUM $906,000.00 dollars to house Fernandez for 40 years. That is $906,000.00 that could go towards a PROPER drug education system, lower taxes, education, etc.

It sad this lady will lose a good chunk of her life, while her children and family will suffer. There were no victims in her crime, just customers. Even sadder the owner of Happy Harry’s or Empire liquors, are viewed as respected businessmen, while this lady is facing a prison term for providing a much less harmful product.
I could kill you all day with stats about justification for marijuana legalization but will leave you with just one. The top contributors to fight Prop 19(marijuna legalization California) were beer companies and the union for prison guards.

We waste billions on prosecuting nonviolent drug offenses. A total waste. If I am ever called to a jury for such crimes, I will always vote not guilty. If more people did that, then the feds would stop wasting resources incarcerating people who sell an essentially harmless substance like marijuana . Are you aware of the fact that there is an actual prison lobby? Don’t you get the fact that the DEA is just another bureacracy looking to constantly expand its take of the federal largesse?

As it lies right now she violated the law therefore she gets whats coming.
That said North Dakota does have a history of hemp production and we only stand to make money if it is legalized. The whole taxation argument though I don’t think is a good one. Someone pointed out 70 billion dollars spent on corrections. That money goes somewhere. We are still going to have to police it based upon every law I’ve seen proposed to “fix” the “problem”.

Cruel and unusual punishment. Nobody has ever died from using marijuana. Thousands are dying because we refuse to legalize it. How sad that it is that the dangers of selling or growing marijuana are far greater than the perceived dangers of actually using it.

Did not realize pot was such a headliner anymore. It say’s the lady is 29, her face looks many years older than that. I think everyone is tired of the big bust, how many big pot busts have we had and nothing ever changes. I feel there are many, many more people making money selling pot than just this one couple in Fargo. If the state keeps busting on pot I feel it will drive pot smokers to something more dangerous to themselves and the public. I have witnessed co-workers drink full bottles of cough medicine mixed with soda and the results are far worse than smoking pot, the guy was a complete basket case for almost 12hrs.

I think this is too long of a sentence for a drug offender especially when the drug is Marijuana. We let pedophiles, rapists and murderers go on lesser sentences.

Forty years for this crime does sound severe given the US acceptance of illegal drugs. When President Reagan declared a “war on drugs”, he started legal actions such as these. But it cannot go unnoticed that the lady she is Hispanic. Would the penalty be the same if her name had been Peterson or Johnson? I wonder. What do you think? Was she given a more severe penalty because of her ethnicity?
