While most states (perhaps all?) allow clergy to act as agents of the state in granting marriage licenses, this does not require them to perform the act for anyone who wants it.

No, not the catholic church or any church for that matter is required to perform a marriage cerimony if they don’t want to. Most churches will accept to get the money but the couple must go though a counceling session with the preist that will perform the cerimony. I went though the same thing that Please Explain went though. I would have had to convert to catholisism in order to get married there. The constitution does not ban all rights not explicitly granted by it. It is meant to protect unalienable rights and grant the federal government specific powers. So even though the Constitution does not spell out the right for same sex couples to marry that does not mean they are unable to.
I strongly believe that the solution to this problem is to separate the religious and state aspects of unions. Religions should be able to grant marriages (allowing religious institutions to choose who to marry according to their beliefs and practices) while the state can grant civil unions for all couples, giving them the same privileges (state and federal) that married couples enjoy today.

@Dent, marriage is a LEGAL practice. The wedding is religious. Even if they go into semantics with it (granting civil unions for all), everyone will still declare themselves married.
The ceremony and the contractual signing should be kept separate. I don’t see why clergy should be allowed to act as agents of the state. Not to say that they shouldn’t, either, but it would seem like a good way to simplify things. Go to your church for the religious ceremony, and go to the courthouse for the legal process.

@Zardoz, I heard of her. She is a single woman killed by a psychotic youth with a history of childhood abuse. He killed the woman not because of her beliefs but because of a psychotic lapse which caused him to relive the abuse he received from his mother. In a violent fit of rage, he killed the woman. He was convicted appropriately and will serve life in prison.
It was a travesty and it’s a shame such bigoted groups would abuse the tragedy of her death for some dishonest personal gain. The woman died. She was the victim of of a young man who grew up in an abusive household. Her death was not the result of “gays attacking heterosexuals” but the sad consequence of domestic abuse.

That’s horrible. There is no reason for violence against supporters of Prop 8. It isn’t an excuse, but these still don’t come close to the violence and hatred toward gays. And, the country has a history of violence on both sides when those fighting for civil rights are denied rights by those opposed to them. Americans who are denied equal rights are often very passionate and do get violent toward people who want to deny them their civil rights. It’s a sad fact, but the fight for civil rights is no stranger to acts of violence. We can only hope that some day all citizens of the United States will have the same right to life, liberty, and the pursuit of happiness regardless of race, gender, sexual orientation, religious beliefs (or lack of), physical ability, age, etc…

For every example you provide, I am sure there are at least, at LEAST 10 examples that can be provided where gay people have been the targeted of hatred, intolerance and violence. I can think of several stories of gays who were beaten simply because they were gay or perceived to be gay.

There is a reason for the checks and balances in this country. This judge did their duty in not allowing the majority to deny rights to the minority. Your perception of morality is not enough to deny U.S. citizens their civil rights.
A majority of Californians also voted many years ago to all people to discriminate based on race who they sold their home to. The courts stepped in to state that this was unlawful.
Just because the majority wants something doesn’t mean it’s right. One purpose of our court system is to ensure that the majority does not deny rights to the minority. That’s exactly what this judge did.

First: In the August 4, 2010 federal district court decision in Perry v. Schwarzenegger, which overturned California’s Proposition 8, Judge Vaughn Walker cited Loving v. Virginia when justifying his conclusion that “the right to marry protects an individual’s choice of marital partner regardless of gender”. Judge Vaughn Walker is not a lefty … he was nominated by G.H.W. Bush and believes in a right wing conservative approach to law.

You can present them with Supreme Court cases, links to Fox News interviews with conservative lawyers explaining it, and pertinent case law on the subject but they won’t accept it because the thought of it is too “icky”. You brought up the argument that homosexuality doesn’t happen in animals and there is indeed proof of homosexuality in animals. Not just the example of my cat. There is plenty of proof if you are willing to look at it honestly.
As far as being born gay, well, I don’t agree with that. I think it’s a matter personal choice in most cases.
No one said that you had to agree with the homosexual lifestyle. What consenting adults do behind closed doors isn’t for our government to dictate. Pray for them. Stop trying to cram your moral beliefs down their throats. Love the sinner, hate the sin and pray.
They should be given the same legal rights as hetero couples and all the responsibility and obligations that comes along with it, as I believe is their Constitutional right.

Given that ND is a very conservative state, I can hardly believe that this is even an issue. Everyone knows that no Republicans are gay. Just doesn’t happen. All Republicans are straight, hardworking, rich, straight, business owning, staight, religous, straight, tolerant individuals. Taking a step back here, these debates are exactly why the government should not be involved in marriage. What business does the government have intervening in romantic relationships between people? If people want religious or secular celebrations of their commitment to each other, good for them, but it’s not City Hall’s business.

Our constitution was written with the express intent of protecting religious groups from the government. It would be wholly unconstitutional for the government to force churches to perform any type of ritual or worship service. Everyone I know supports same-sex marriage and none of them favor the government meddling in the practices of religious groups.
