What I have found, however, are several peer-reviewed articles that indicate that carcinogens in marijuana smoke aren’t metabolized as readily as they are in cigarette smoke. Read this:

The intent, Bob, comes from Mr. Kennedy’s decision to go home and wait to report the accident… knowing that she would not survive while he sobered up prior to making the call. Did he intend to put the car in the pond? Probably not. I get what you’re saying – and you are right, Bob. By today’s standards, he would be charged (were he an “average joe”) with murder 2, or manslaughter… by the standards of those days, I don’t know what he would have typically been charged with. But he was given a pass… and lots of folks have never forgiven Ted, regardless of all the work he did trying to get past that time in his life.
Of course – then there’s the other side of the coin (in terms of the innocent bystander) – if someone does step in to try and help (a good samaritan) and it backfires, causing further injury or death, that person can then face criminal charges… all for trying to do the right thing… How ridiculous is that?

Somehow I don’t think they had that capability back in ’69, bob. The breathalyzer wasn’t put into service until the late 80′s, and even now, they’re finding that it’s not all that accurate.
Even now, there are so many variables, (metabolic rate, whether you’ve slept, BMI, etc), that it’s hard, if not impossible to get an accurate blood alcohol content of an individual ten hours previous.
